Right of withdrawal

If you are acting as a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded. To exercise the right of withdrawal, you must inform VibuCard SL of your decision to withdraw from the contract by means of a clear declaration (e.g. by email or post). In the event of an effective withdrawal, the services received by both parties must be returned and any benefits derived (e.g. benefits of use) must be surrendered. If you have already made full or partial use of the contractual service, you must pay us compensation for the value. The right of withdrawal expires prematurely if the contract is fully fulfilled by both parties at the express request of the customer before you have exercised your right of withdrawal. This is also the case if the digital profile has been created. The right of withdrawal described here does not apply to contracts with business customers and to customized products (NFC accessories) that were delivered with the personal ID.

Consequences of revocation

In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return or surrender the service received and benefits (e.g. benefits of use) to us, or only partially or in a deteriorated condition, you must pay us compensation for the value. You only have to pay us compensation for the deterioration of the item and for benefits derived if the use or deterioration is due to handling of the item that goes beyond checking its properties and functionality. “Checking the properties and functionality” means testing and trying out the respective goods, as is possible and usual in a store, for example.

Items that can be sent by parcel are to be returned at our risk. You must bear the regular costs of return if the goods delivered correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or if, in the case of a higher price of the item, you have not yet paid the consideration or a contractually agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you. Items that cannot be sent by parcel will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your cancellation notice or the item, and for us when we receive it.

Exceptions to the right of withdrawal

The right of withdrawal described here does not apply to the delivery of goods that were manufactured according to your own and individual specifications (§ 312d Paragraph 4 BGB). This includes, for example, the selection of colors, your own logos, articles with a written ID on the NFC chip as these are individually manufactured on demand. Software is also excluded from the right of withdrawal as soon as a one-time use has already taken place.
